Being Asked for Compensation due to Resignation

Good day. I want to ask again for advice related to my previous post. It has been my 9th year in the company and I have renewed my contract several times already. Now, I decided to resign with proper notice as per policy. Supposedly my contract will end January next year. Now, my company is insisting that I really need to pay the remaining months of my current contract since I am non-Saudi and my contract will always be a fixed-term contract. What can I do about it? Do I have any right to file complain? Thank you.

Hi! Same situation as mine. I got rejected last week. I gave them 3 months notice thinking that it’s enough time to find replacement for my position. Turned out, I have to pay the remaining months of my contract which will end until April 2026. Me too, I don’t really have any certain solution about it but I’ve read that if we have valid reason for quitting, I guess they might consider letting us go. I’m really not sure. And also, if our contract is fixed, we have to pay the months left in our contract. and If it’s an indefinite contract, we only have to pay 15 days worth each year. (But remember if your reason for quitting is valid we don’t have to consider compensating them.)

Fixed term contracts mean exactly that.  Any party that terminates the contract has to pay for the balance period.  The only way out of it is to manage this with your company and try to convince them.

What if the debtor not able to compensate that huge amount?

Thats why I said that you need to discuss with your employer.  Otherwise you are stuck if they go to court.

The problem is current employer not giving any room for negotiation even after providing an alternate resource and I'm ready to continue here till the new resource joins. Also ready to compensate two months of my salary. Not giving me exit as well..


I accepted the transfer request through Qiwa and it seems like my sponsor will get changed after notice period completion.


Will I be imprisoned if I cannot pay the compensation if they are asking for? J

No.  But if they go to court and win, you will have to pay.

It's unfair they ask for remaining 2 years salary even though I provided them with an alternate resource. They are not giving me exit. On reality, there is no material loss for them. It's like a trap and I got stuck with them


So the worst is they can send me back to my home country if I could not pay the compensation they are asking for right? There will not be any imprisonment for failing to pay the amount?

I already told you.  You won't be able to leave if the court orders a travel ban.

Complicated. I don't have the money they are asking for and they are not letting me to take exit as well. It's not that I borrowed the money from them and not repaying it. I just want to resign from my current job and move back to my home country. They made me feel like I'm a prisoner who committed a crime.


There is no other way??

Go to labour court but be aware that you signed a limited term contract which has clear compensation clauses.


Or try to get an exit re-entry and just get on a plane and leave.  But be prepared to never come back to Saudi again.
