Clarification on Labour rights

Inshaffazil94

Dear Sir,

I came to Saudi Arabia on a fixed-term contract of 2 years in August 2019 as an Audit Technician, however, In June 2021 I am planning to leave my current organization since the package is insufficient to meet my personal commitments and I got a very good offer and am planning to take it as an Accountant.

Nevertheless, Once I informed the current employer regarding this and requested him my transfer he is neglecting and trying to "final exit" me, Which I rejected. Also, I have given one month notice till June 25, 2021, and for the balance months I had said "I don't need my ESB and Vacation Pay amounting to 7,500 SAR"

Could you please advise me on this?

How can I get my transfer completed?

Dear Inshaffzill,

- Does your employment contract gives either party the right to terminate the contract without expressing a reason ?

- Have you submitted a resignation yet ?
- is your contract registred ?

Your employer has full authority.
You can not bypass him without his permission. Ask him to give you the transfer and if he is not ready for that then continue to work for him.
Otherwise, he can put final exit on your visa.
It is the law.
He has the full and final authority.

Dear Inshaffzill,

- Does your employment contract gives either party the right to terminate the contract without expressing a reason? Yes, 1 amount resignation notice and amount there off.

- Have you submitted a resignation yet? Since I had the offer, I had a chat with my HR and submitted one via email though it is not responded to till now with a proper answer.

- is your contract registered? I think they used an agreement of a body in the UK, however, they are not a member of it. So I guess there is a weak link here.

Seriously, How can he decide to put us down and keep ourselves low, when we are to climb the next ladder in life.

You should have thought that before coming here on a company visa.
Now, do whatever you want to do.
I only told you the ultimate and bitter truth which you don't want to hear.
I did my part to help you, now you can do whatever you like.
You will face the consequences, not me.

My Answer: Yah bro, I can understand, and thanks a lot.
